On 21 April 2026, the European Commission published Commission Regulation (EU) 2026/859, amending Annex XVII to Regulation (EC) No 1907/2006 (REACH), which introduces new restrictions on 2,4-dinitrotoluene (2,4-DNT) in articles.
Closing the imported articles gap
2,4-DNT (CAS No 121-14-2) is classified as a Carc. 1B substance and considered a non-threshold carcinogen, meaning that no safe exposure level can be established. Although the substance has already been subject to authorisation requirements under Annex XIV, its presence in imported articles was not addressed. The Commission noted that, although the substance is no longer used within the EU, articles containing 2,4-DNT could still be placed on the market via imports.
New restriction and timeline
The amendment introduces a new entry in Annex XVII, prohibiting the placing on the market or use of 2,4-DNT in articles at concentrations equal to or greater than 0.1% by weight. The restriction applies to both professional users and the general public.
The measure will apply from 11 May 2027, 20 days after its publication in the Official Journal of the European Union.
Derogations and transitional measures
The regulation includes targeted derogations for specific uses, such as certain explosives and defence-related applications. In addition, longer transitional periods are provided for particular sectors, including components used in automotive safety systems. Articles already on the market before 11 May 2026 can continue to be used.
