On 7 May 2026, Taiwan’s Ministry of Labour (MoL) published draft amendments to the Regulations for the Labelling and Hazard Communication of Hazardous Chemicals for public consultation. The proposal published in the Taiwan’s Official Gazette, would update chemical hazard classification, labelling elements, Safety Data Sheet (SDS) requirements, as well as related compliance provisions in order to align them with the eighth revised edition of the Globally Harmonized System of Classification and Labelling of Chemicals (GHS) and the updated CNS 15030 national standards.  

The draft proposes amending selected provisions of the regulations as well as Appendix 1 of Article 5 and Appendices 3 and 4 of Article 12. 

Background 

The regulations were originally implemented in 2007 and have been amended twice, most recently on 9 November 2018. According to the MoL, the current draft aims to further align Taiwan’s hazard communication framework with updated GHS requirements and improve SDS accuracy and completeness. 

Key Insights from the Draft 

The draft notice includes the following amendments: 

  • Adding the hazard class for desensitized explosives, revising classifications for flammable gases, aerosols and chemicals under pressure, and updating terminology for several health hazard classes.  

  • Revising the SDS format by removing certain fields, such as odour threshold and evaporation rate, and adding fields such as kinematic viscosity, particle characteristics, and bulk cargo transport information. 

Obligations for Stakeholders 

Manufacturers, importers, and suppliers would remain responsible for ensuring that SDS information is accurate and complete. In the event of any errors, omissions, or clear inaccuracies in SDSs, the competent authorities or labour inspectors can require corrections to be made within a given period. Failure to make corrections may result in penalties. 

Comment Period and Enforcement Dates 

Interested stakeholders can submit comments until 6 July 2026. Most amendments are scheduled to take effect from the date of promulgation, while the revised Annex 1 of Article 5 and Annex 4 of Article 12 are scheduled to take effect on 1 January 2028.
