On 24 March 2026, the Ministry of Economy, Environment and Agriculture of Ukraine (MoEEA) published a draft Resolution of the Cabinet of Ministers of Ukraine titled “On Approval of the Procedure for State Registration of Chemical Substances.” The document has been released for public consultation.
The draft act is intended to implement the requirements of the Ukrainian chemicals framework (UA REACH) by establishing a detailed procedure for the registration of chemical substances.
Scope and Application
The proposed Procedure applies to chemical substances manufactured in Ukraine, imported into the country, or placed on the market, including substances contained in mixtures or other chemical products.
In line with UA REACH principles, the obligation to register applies where the annual quantity of a substance reaches 1 tonne or more. The volume is calculated based on the average quantities over the previous three calendar years or, for new substances, based on planned annual volumes.
The Procedure therefore provides the operational mechanism through which existing registration obligations under Ukrainian legislation will be implemented in practice.
Key Elements of the Procedure
The draft establishes a structured process for submitting and reviewing registration applications. Applicants are required to provide relevant administrative information, substance identification data, and supporting documentation as defined by Ukrainian law.
The Procedure also introduces mechanisms similar to those under EU REACH. This includes the possibility of joint submission of data for identical substances, as well as the option for an operator to refer to relevant documents previously submitted by other operators, provided that such references are officially authorized.
Applications must be submitted to MoEEA either in paper form or electronically via the Unified State Web Portal of Electronic Services, including the Chemical Safety Information System. The review period for applications is 30 calendar days, after which MoEEA issues the decision electronically.
Once granted, the registration is valid indefinitely, and the substance is included in the State Register of Chemical Substances.

The draft Resolution clarifies several cases where state registration of chemical substances is not required:
Regulatory Context and EU Alignment
The Procedure has been developed pursuant to Article 38 of the Law of Ukraine “On Ensuring Chemical Safety and Management of Chemical Products” and complements the existing UA REACH framework.
It is also designed to align with Regulation (EC) No 1907/2006 (REACH), particularly in terms of registration processes, data sharing, and administrative procedures. This reflects Ukraine’s continued efforts to align its chemical legislation with EU standards.
Procedural Aspects and Decision-Making
MoEEA is responsible for reviewing registration applications and issuing decisions on registration or refusal. If deficiencies are identified in the submitted documents, the application may be suspended until corrections are made. Grounds for refusal include incomplete documentation or inconsistencies in substance identification data.
Following registration, information is recorded in the State Register and shared through relevant national information systems, including the “Single Window for International Trade.”
Public Consultation
The draft Resolution is open for public consultation. Stakeholders are invited to submit comments and proposals to MoEEA within one month from the date of publication.
Conclusion
The proposed Procedure represents an important implementing measure under Ukraine’s UA REACH framework, providing clarity on how the registration of chemical substances will be carried out in practice.
By formalizing the registration process and aligning it with EU approaches, Ukraine continues to strengthen its system of chemical safety regulation and regulatory transparency.
