On 28 July and 4 August 2026, the Ministry of Economy and Environment of Ukraine published two important draft regulatory acts concerning chemical safety management and chemical product information requirements.
The proposed documents are another step in Ukraine’s ongoing efforts to align its chemical regulatory framework with European Union legislation, including key principles of EU REACH, CLP, PIC, and Mercury Regulations.
1. Draft Amendments to the Law of Ukraine on Chemical Safety and Management of Chemical Products
The draft Law “On Amendments to Certain Laws of Ukraine Regarding Ensuring Chemical Safety and Management of Chemical Products” aims to improve the existing framework established under the Law of Ukraine No. 2804-IX “On Ensuring Chemical Safety and Management of Chemical Products.”
The proposed amendments focus on strengthening chemical risk management throughout the entire life cycle of chemical products and improving consistency between different provisions of the legislation.

The proposed amendments also address Ukraine’s obligations following its accession to the Minamata Convention on Mercury, including requirements relating to the management, use, storage, and disposal of mercury and mercury-containing substances.
In addition, the draft introduces adjustments related to administrative procedures and insurance mechanisms within the chemical safety framework. The explanatory materials refer in particular to the development of specialized liability insurance for businesses whose activities involving hazardous chemicals may cause harm to workers, third parties, or the environment, as well as improved access to reliable chemical safety data for risk assessment purposes.
2. Requirements for Safety Data Sheets (SDS) and Safe Use Instructions
Alongside the legislative amendments, Ukraine has proposed a draft Cabinet of Ministers Resolution establishing Rules for the Development of Safety Data Sheets (SDS) for Chemical Products and Requirements for Safe Use Instructions.
This draft regulation has been developed in accordance with Article 41 of the Law of Ukraine No. 2804-IX and aims to establish clear requirements for communicating hazard information and risk management measures throughout the supply chain.
The proposed requirements closely align with the principles of EU REACH, particularly Articles 31–34 and Annex II concerning Safety Data Sheets.

The structure of SDSs follows the internationally recognized 16-section format, covering areas such as hazard identification, composition, first-aid measures, handling and storage, exposure controls, physical and chemical properties, toxicological information, ecological information, disposal considerations, transport information, and regulatory information.
For chemical products for which an SDS is not required, suppliers would need to provide Safe Use Instructions containing sufficient information to enable users and consumers to identify hazards and apply appropriate risk control measures.
