EU Updates PIC Regulation with New Listings for Pesticides and Industrial Chemicals

On 9 June 2026, the European Commission adopted a delegated regulation amending and correcting the annexes to the EU PIC Regulation concerning the export and import of hazardous chemicals. These amendments update Annexes I and V to reflect recent regulatory developments under EU chemicals legislation, as well as decisions adopted under the Rotterdam and Stockholm Conventions. The Regulation will apply from 1 October 2026.

Background

The PIC Regulation (Regulation (EU) No 649/2012) implements the Rotterdam Convention within the EU. It governs the export and import of certain hazardous chemicals, including export notification requirements, and for chemicals listed under the Convention, the Prior Informed Consent (PIC) procedure. Annex I lists chemicals subject to export notification or the PIC procedure, while Annex V lists chemicals whose export from the EU is prohibited.

Main Amendments

The delegated regulation adds several industrial chemicals and pesticides to Annexes I and V of the PIC Regulation, following recent regulatory actions under the REACH Regulation, the Plant Protection Products Regulation, the Biocidal Products Regulation and the Persistent Organic Pollutants (POPs) Regulation. These include several UV absorbers (UV-328, UV-327, UV-320 and UV-350), Dechlorane Plus, polyhexamethylene biguanide hydrochloride (PHMB), trichloroethylene, DEHP and DBP, as well as several chromium compounds and withdrawn pesticide active substances. The Regulation also updates the Rotterdam Convention listings by adding carbosulfan and fenthion (ultra-low-volume formulations at or above 640 g active ingredient/l) to Part 3 of Annex I, making them subject to the Convention's Prior Informed Consent procedure.

Export Bans under Annex V

The delegated regulation also amends Annex V to introduce export bans for UV-328, Dechlorane Plus and methoxychlor. These bans reflect the inclusion of these substances in Annex I to the EU POPs Regulation, and they apply subject to the exemptions and concentration limits specified in that Regulation.

Entry into Application

The delegated regulation will enter into force on the twentieth day following its publication in the Official Journal of the European Union. Its provisions will apply from 1 October 2026.
