The Government of Canada has amended Schedule 3 of the Canadian Environmental Protection Act, 1999 (CEPA) through Order SOR/2026-28, which updates the export controls on hazardous substances. Published on February 25, 2026, this amendment aligns Canada’s Export Control List (ECL) with its international obligations under the Rotterdam and Stockholm Conventions. These changes ensure that substances that are prohibited or restricted domestically are also subject to strict export notification and control requirements.
New Substances Added to Export Control List (Part 2 – International Controls)
Several substances listed under international conventions have been added to Part 2 of the Export Control List, meaning their export is now subject to notification and consent procedures. These include hexabromocyclododecane (CAS 25637-99-4) and its isomers (CAS 3194-55-6, 134237-50-6, 134237-51-7, 134237-52-8), as well as polybrominated diphenyl ethers (PBDEs), including those with the following CAS numbers: CAS 40088-47-9, 32534-81-9, 36483-60-0, 68928-80-3, and 1163-19-5. In addition, phorate (CAS 298-02-2) has been moved to Part 2 following its inclusion under the Rotterdam Convention.
Substances Added to Export Control List (Part 3 – Domestic Restrictions)
The amendment also introduces substances subject to domestic restrictions to Part 3 of the Export Control List. These include ferbam (CAS 14484-64-1). Additionally, Dechlorane Plus (CAS 13560-89-9) will also be added but will not come into force immediately, in order to align with future domestic restrictions under the Prohibition of Certain Toxic Substances Regulations, 2025.
Updates to Existing Listings and Clarified Chemical Entries
The Order revises several existing entries to improve clarity and consistency with international frameworks. Substances with updated listings include polybrominated biphenyls (CAS 36355-01-8, 27858-07-7, 13654-09-6) and polychlorinated terphenyls (CAS 61788-33-8). Other revised listings include phosphamidon (CAS 13171-21-6, 23783-98-4, 297-99-4) and 2,3,4,5-bis(2-butylene)tetrahydro-2-furaldehyde (CAS 126-15-8).
Revised Listings for Hazardous Pesticides and Industrial Chemicals
Further updates apply to hazardous pesticides and industrial chemicals under Part 2. These include dinoseb (CAS 88-85-7), pentachlorophenol (CAS 87-86-5), and dinitro-ortho-cresol (DNOC) (CAS 534-52-1) as well as its salts (CAS 2980-64-5, 5787-96-2, 2312-76-7). The listing for endosulfan (CAS 115-29-7) and its isomers (CAS 959-98-8 and 33213-65-9) has also been updated.
Regulatory Impact and Compliance Requirements
With these amendments, exporters must comply with the Export of Substances on the Export Control List Regulations (ESECLR). This includes providing prior notification and, where applicable, obtaining export permits. This update enhances control over the export of hazardous chemicals while ensuring alignment with international chemical management frameworks and supporting the protection of the environment and human health.
