On 27 April 2026, Taiwan’s Ministry of Environment announced amendments to the “Listed Toxic Chemical Substances and Their Management Requirements” under the Toxic and Concerned Chemical Substances Control Act (TCCSCA). The revised requirements will officially enter into force on 1 July 2026.
The update introduces revised management requirements for controlled toxic chemical substances, including operational restrictions, storage obligations, labelling requirements and exemptions for certain regulated products and applications.
Key Regulatory Updates
The amendment was issued under Articles 8, 11 and 44 of the Toxic and Concerned Chemical Substances Control Act.
Key changes and requirements include:
Updated lists of controlled toxic chemical substances, control concentration thresholds and graded operational quantities.
Updated prohibitions on certain operations involving toxic chemical substances.
Clarification of permitted uses for listed toxic chemical substances.
Transitional compliance obligations for operators who were already using substances before official listing.
Expanded management and storage requirements for toxic chemical substances.
Additional labeling obligations for certain prohibited food-related substances.
Clarification of substances and products excluded from TCCSCA control.
Storage and Operational Control Requirements
The revised regulation strengthens the operational management obligations for toxic chemical substance operators.
Key storage requirements include:
Toxic chemical substances must be stored in sealed and durable containers to prevent release or leakage.
Storage locations must be managed by designated personnel.
Asbestos must be stored in enclosed facilities with measures to prevent dispersion.
Certain highly hazardous substances, including polychlorinated biphenyls (PCBs), phosgene, methyl isocyanate, chlorine, 1,3-butadiene and hydrogen cyanide, are prohibited from being stored in residential or commercial areas.
Labeling Requirements for Certain Substances
Taiwan also introduced enhanced labeling obligations for specific regulated substances.
Operators handling substances such as malachite green, maleic acid, maleic anhydride, melamine and coumarin derivatives must:
Clearly display the statement “Prohibited for Food Use” in Chinese.
Ensure the label covers at least 35% of the packaging surface.
Use contrasting colors for text and background.
Additional substances, including Sudan dyes and certain industrial colorants, must display the statement “Prohibited for Food and Feed Use” in Chinese.
Exemptions and Scope Clarifications
The revised regulation confirms that substances already regulated under other sector-specific laws are excluded from TCCSCA control. These include substances regulated under legislation related to pesticides, pharmaceuticals, cosmetics, food safety, petroleum, natural gas, radioactive materials and waste management.
Certain finished articles containing chromium compounds, mercury, cadmium, phthalates and bisphenol A may also be exempted under specified conditions.
Regulatory Impact
The amendment reflects Taiwan’s continued efforts to strengthen the management of chemical substance, environmental protection and the control of hazardous substance under the Toxic and Concerned Chemical Substances Control Act framework.
Companies that manufacture, import, store or use listed toxic chemical substances in Taiwan should review the updated requirements and assess their potential compliance obligations before the 1 July 2026 implementation date.
