Annex XVII EU REACH CMR Substances Nanomaterials CLP Regulation Consultation

On 9 January 2026, the European Commission published a draft amendment to Annex XVII of the REACH Regulation (Regulation (EC) No 1907/2006) concerning consumer restrictions for carcinogens, germ cell mutagens and reproductive toxicants (CMRs). The draft is open for stakeholder feedback under the Commission’s Better Regulation framework until 6 February 2026.

The proposal would update the appendices linked to Annex XVII entries 28–30, in line with recent harmonised classifications under the CLP Regulation.

Substances and substance groups concerned

The draft amendment includes a range of substances and substance groups covered by the appendices linked to Annex XVII entries 28–30, including:

  • Substances listed in connection with updated harmonised CMR classifications under CLP.

  • Nanomaterials, including multi-walled carbon nanotubes.

  • Substances used in mixtures, in connection with the application of CLP additivity rules for mixture classification.

  • Substances with specific use conditions, including nitrous oxide (E942), which is addressed under the CMR restriction framework with defined conditions for food additive uses.
