Peru Chemical Inventory Information

Peru has advanced its chemicals management framework through Legislative Decree No. 1570, of May 28, 2023, which approves the Law on Comprehensive Management of Chemical Substances. This decree aims to protect human health and the environment by regulating the life cycle of chemical substances, with an emphasis on the classification, labelling, and risk assessment of hazardous chemicals. 

A central component of this Decree is the creation of the National Registry of Chemical Substances (RENASQ), which is intended to serve as a comprehensive inventory of chemical substances manufactured, imported, or used in Peru. While the registry is under development, the total number of substances it will include has not yet been determined. 

On July 24, 2024, the Ministry of Environment (MINAM) published a draft Supreme Decree which will approve the legislative Decree No. 1570, which details the classification, reporting, and prioritization of hazardous substances. This draft mandate that manufacturers and importers register hazardous substances in accordance with the sixth revised edition of the Globally Harmonized System of Classification and Labelling of Chemicals (GHS 6). 

The draft Supreme Decree introduce a list of "predicted chemical hazard classifications" comprising 4,404 substances. Registration timelines depend on whether a substance aligns with this classification: 

  • Substances matching the predicted classification: Subject to specific registration deadlines as set out in the draft Supreme Decree. 

  • Substances not matching the predicted classification: May have different registration requirements and timelines. 

Specific cut-off dates and detailed criteria for inclusion are expected to be finalized when the regulations are officially published. 

Regulatory Obligations: 

  • Listed Chemicals (included in RENASQ): 

  • Compliance: Must adhere to hazard standards, including GHS-aligned classification, labelling, and provision of Safety Data Sheets (SDS). 

  • Risk Assessment: Subject to risk evaluations to determine potential health and environmental effects. 

  • Non-Listed Chemicals (new substances): 

  • Notification: Manufacturers and importers are required to notify authorities and submit comprehensive hazard assessments prior to approval and market entry. 

  • Approval Process: Must be evaluated to ensure compliance with safety standards before being permitted for use or placed on the market. 

The draft Supreme Decree anticipates provisions to protect trade secrets and sensitive business information. Companies may request confidentiality for specific data submitted during the registration process, which will be assessed by regulatory authorities to balance transparency with the protection of proprietary information. 

By implementing these measures, Peru aims to establish a robust chemicals management system in line with international standards, ensuring the safe use of chemical substances while promoting environmental and public health protection.
