Peru - GHS Status

GHS Status

Peru has adopted the sixt revised edition of the UN GHS (GHS 6) in July 2024 through the Supreme Decree Proposal, which approves the provisions of Legislative Decree No. 1570. This Supreme Decree Proposal was notified to the World Trade Organization (WTO) on 28 August 2024. In addition, Ministerial Resolution No. 00214-2024, which authorized the publication of the Supreme Decree Proposal, was published on 24 July 2024. At the same time, a public review was opened allowing stakeholders to submit opinions and suggestions regarding the Supreme Decree Proposal until 24 October 2024. 

In accordance with the GHS provisions, Peru has also published the following decrees:
  • Legislative Decree No. 1570, entitled "Legislative Decree Approving the Law on the Comprehensive Managment of Chemical Substances" (published on 28 May 2023)
  • Supreme Decree 031-2023-SA, entitled "Approving the Regulation and Supervision of Hazardous Substances for Domestic, Industrial and Public Health Use" (published on 2 December 2023)

Local Adaptation of GHS: 

The following GHS building blocks have not yet been adopted in Peru:

  • Acute toxicity (oral, dermal and inhalation), Category 5

GHS Labelling Requirements

In Peru, labelling requirements are established in Article 7 of the Supreme Decree Proposal. Labels must be in Spanish and include the following elements:

  • Product identifier 
  • Hazard pictograms
  • Warning word
  • Hazard Statement
  • At least 1 precautionary statement 
  • Additional Information 

Safety Data Sheets 

Safety Data Sheets (SDS) must be prepared in accordance with Annex 4 of GHS 6. Additonal requirements are set out in Article 8 of the Supreme Decree Proposal. The SDS must:

  • Follow the standard 16-section format
  • Be written in Spanish, but manufacturers and importers may optionally include translation into other lanuages at the discretion of the manufacturer or importer
  • Be privded free of charge and in digital format

Manufacturers and importers must update the SDS within within 6 months under the following conditions:

  • When new information on hazard classification or risk management becomes available
  • When a new restriction or prohibition is introduced in national regulation

GHS in Transportation 

Peru follows te UN Model Regulation on the Transport of Dangerous Goods. This is supported by Law No. 28256, entitled Regulation for the Land Transportation of Hazardous Materials and Waste.
