On April 13, 2026, the U.S. Environmental Protection Agency (EPA) issued a final rule amending the start of the reporting period under the Toxic Substances Control Act (TSCA) Section 8(a)(7) for per- and polyfluoroalkyl substances (PFAS). This revision provides additional time for stakeholders to prepare for compliance with the PFAS Reporting Rule.
Updated Reporting Timeline
The submission period will now begin on January 31, 2027, or 60 days after the effective date of a forthcoming final rule on reporting requirements, whichever is sooner. The current six-month reporting duration remains unchanged, with extended timelines for small manufacturers importing PFAS in articles.
Reason for the Delay
EPA introduced this change to allow sufficient time to review extensive public comments, finalize pending rule revisions, and update reporting tools and guidance. The adjustment is intended to ensure accurate data submission and reduce the risk of misaligned compliance efforts.
Regulatory Impact
This rule applies to entities that have manufactured or imported PFAS since January 1, 2011, including sectors such as manufacturing, utilities, and waste management. This action does not introduce new obligations, but rather delays the reporting start date to ease the compliance burden.
