On January 5, 2026, the U.S. Environmental Protection Agency (EPA) announced a procedure to notify companies about the upcoming expiration of Confidential Business Information (CBI) claims under the Toxic Substances Control Act (TSCA). This update outlines how EPA will manage notifications and extension requests for CBI claims approaching the end of their statutory protection period. 

 

Background on TSCA CBI Expiration 

Under TSCA, companies may claim certain chemical details such as identity, structure, or use as confidential. These claims typically remain valid for 10 years. Following amendments introduced by the Frank R. Lautenberg Chemical Safety Act in June 2016, the first set of CBI claims submitted under the amended framework will begin to expire in June 2026. 

 

Notification and Review Process 

In early spring 2026, EPA will publish an initial list of TSCA submissions with CBI claims scheduled to expire starting in June 2026 on its TSCA CBI website. Submitters will also receive direct notifications via EPA’s Central Data Exchange (CDX) system. Companies are encouraged to review these listings promptly and determine whether an extension is needed. For chemical identity claims, expiry dates are indicated in the “EXP” column of the TSCA Inventory. 

 

Requesting an Extension 

To maintain confidentiality, companies must submit an electronic extension request through CDX at least 30 days before the claim expires. Each request must include proper substantiation. EPA is developing a dedicated CDX tool for this purpose and will provide updates if implementation is delayed. CBI claims for which no timely extension request is submitted may be disclosed publicly without further notice.
