On October 15, 2026, the U.S. Environmental Protection Agency (EPA) published a final rule establishing Significant New Use Rules (SNURs) for 19 chemical substances under the Toxic Substances Control Act (TSCA). These substances were previously the subject of premanufacture notices (PMNs) and orders issued by EPA under TSCA. The rules require notification at least 90 days before commencing the manufacture, including import, or processing of a covered substance for an activity designated as a significant new use.

Chemical Substances Covered by the Final Rule

The final rule establishes SNURs for 19 chemical substances listed in 40 CFR Part 721. The substances, corresponding regulatory sections, PMN numbers, and Chemical Abstracts Service Registry Numbers (CASRNs) are provided below.

90-Day Notification Requirement

Under the final rule, any person intending to manufacture, including import, or process a covered chemical substance for a designated significant new use must submit a Significant New Use Notice (SNUN) at least 90 days before commencing the activity.

The activity cannot begin until EPA has reviewed the notification, made the appropriate determination, and taken any necessary action. This requirement allows EPA to evaluate the proposed use before it proceeds.

Effective Date and Regulatory Impact

The final rule will become effective on December 14, 2026. Companies manufacturing, importing, or processing the listed substances should review the applicable SNUR provisions and existing TSCA orders to determine whether their activities constitute significant new uses requiring prior notification.

Regulatory Significance

The final rule strengthens EPA’s oversight of new uses of chemical substances subject to TSCA orders. Businesses planning activities involving the affected substances should assess their operations against the applicable requirements and submit any required SNUN within the prescribed timeframe before commencing a designated significant new use.
